Terms of Sale

01Who you’re buying from

BUYNOW.ART is published by Wundrful, Inc. in Hermosa Beach, California (“we,” “us”). Each work is consigned to us by the artist who made it, and we sell it on the artist’s behalf. Your purchase contract is with us.

02The works

Every work we sell is an original, one of one, by the artist named in the listing. No prints, editions or reproductions. Each listing gives the title, year, medium and dimensions, and is shown in a photo of the actual work. A work comes framed only if the listing says it is framed.

We describe every work as accurately as we can, but colors vary from screen to screen.

03Prices and payment

• Prices are in US dollars. The listed price is the price of the work.
• Prices include insured shipping anywhere in the United States. Sales tax is added where the law requires it.
• Payments are processed by Stripe. We never see or store your full card number.
• If you choose a pay-over-time option such as Klarna or Affirm, that company’s own terms apply to the financing.

04First to buy owns it

Each work is sold to the first buyer who completes checkout. After that, the listing closes and shows as Sold.

If two payments ever go through for the same work, the first completed payment gets it. Any later payment is refunded in full within 5 business days. If a listing contains an obvious error, such as a mistyped price, we may cancel the order before it ships and refund you in full.

05Shipping and delivery

• We ship to addresses in the United States only.
• Shipping is free: every listed price already includes tracked, insured delivery anywhere in the United States.
• Every work ships by UPS, tracked and insured for its full price. The artist packs it to our packing standard and ships it within 5 business days of your purchase, with a prepaid label that we provide. We email you the tracking number when it moves.
• Carrier delivery times are estimates, not guarantees.
• A signature may be required on delivery.

The work is our responsibility until it is delivered to your address. Ownership passes to you on delivery, once your payment has cleared.

06Returns and refunds

Every work is one of a kind and comes off the market the moment you buy it, so all sales are final, with two exceptions:

• It arrives damaged.
• It isn’t what the listing described, for example the wrong work or the wrong size.

In either case, email hello@wundrful.com within 7 days of delivery with photos of the work and the packaging, and keep all the packaging. We’ll send you a prepaid return label if a return is needed. You’ll get a full refund of the price and tax to your original payment method within 10 business days of the work coming back to us, or of our approving a damage report that doesn’t need a return. We take up any claim with UPS ourselves; you don’t have to deal with them.

If you tell us the work arrived as described, or 7 days pass after delivery without a report, the sale is complete and the artist is paid.

If the artist can’t ship the work for any reason, we cancel the order and refund you in full.

If you have a problem with an order, please email us before disputing the charge with your bank. We answer within 2 business days.

07Authenticity

Every artist confirms in writing that each work they list is their own original. If you find that a work you bought is not an original by the named artist, tell us at hello@wundrful.com within one year of delivery. Once the work is returned, we’ll refund you in full.

08Copyright and images

You own the physical work. The artist keeps the copyright, including the right to reproduce the image. You may photograph the work for your own records, for insurance, and to list it if you resell it.

After a work sells, it stays in the BUYNOW.ART archive, marked Sold. We never publish who bought a work unless you ask us to.

09Felix

Felix is a fictional columnist and his column is satire. His opinions, recollections and fainting spells are not statements of fact, and they are not ours.

10Limits on our liability

To the extent the law allows, our total liability for any purchase is limited to what you paid for it, including tax. Nothing in these terms limits rights you have under California or federal consumer law.

11Governing law

These terms are governed by California law. Any dispute will be handled in the state or federal courts in Los Angeles County, California, except that either of us may bring a claim in small claims court.

12Changes and contact

We may update these terms from time to time. The terms in effect on the day you bought a work apply to that purchase.
